ITX Secures Another Exoneration
The Innocence Project of Texas is pleased to announce the exoneration of its client Timmy Lynn Duke from his wrongful conviction for Burglary of a Habitation!
Mr. Duke was accused of breaking into a home in Irving, Texas. He was prosecuted based on a mistaken eyewitness identification by the homeowner. The homeowner saw the man in his home. He thought that man was Mr. Duke. He was wrong.
After many unsuccessful attempts to convince the courts of his innocence, Mr. Duke reached out to the Innocence Project of Texas in 2017. ITX was joined in its investigation by the Conviction Integrity Unit of the Dallas County District Attorney’s Office. The joint investigation established Mr. Duke was actually in a different city (in a completely different county) being questioned by the police on an unrelated matter at the exact time the burglary was occurring in Irving.
With the cooperation and support of the District Attorney’s Office, ITX has now secured a formal exoneration for Mr. Duke.
Mr. Duke was represented by ITX pro bono attorney Bruce Anton and ITX Board President Gary Udashen. This was Gary's 20th case (15 for ITX and 5 as a private attorney) in which he obtained an exoneration either as lead or co-counsel.
